Supreme Court Advisory Opinion No 2 of 2012

This case involved a request for an advisory opinion on whether Article 27(8) of the Constitution relating to the election of women in the Senate and National Assembly was to be applied progressively or immediately in the 2013 General Elections. FIDA joined the case as an interested party to advocate for the immediate application of the 2/3 gender principle. The court ruled that principle did not apply in the 2013 elections but that it was to be applied progressively by 2015. However, the Chief Justice gave a dissenting opinion that the principle could apply immediately.
