CR 151/13 –R-vs- Gilbert Macharia

The accused was charged with creating disturbance. The complainant was his sister-in-law. On examining the case It was felt that the matter was hinging on land. They were referred to Council of Elders Mucharage Location. This matters hinged on land where the family did not know how to share the land amicably and as fairly as possible. The land was approximately 2 acres with half an acre of coffee in the middle. Both parties were entitled to a share but the problem was how to share. After several hours of deliberation with the present members we unanimously agreed the land will be subdivided again. The complainant must be given a foot path form the top to the rural road and since she has a permanent house she should retain the upper part.

The parties agreed to subdivide the land.
